Overview
Copyright laws have been created and enforced to protect the original creative works, such as books, photographs, music, designs, logos, and more. These laws give complete ownership of such works to the creator, and any use (reproduction, distribution, sales, etc.) of these works requires their consent.
Many works on the web are also copyrighted. According to benedict.com, a website all about copyright, materials on the web that can be copyrighted include the following: news stories, graphics, pictures, email, and software (http://www.benedict.com/Info/PublicDomain/PublicDomain.aspx).
Just because something is posted on a web site, it doesn't mean that one is free to take and use it. Those materials are still the property of the owner, and any use of them is prohibited. Also, one is not allowed to post the copyrighted works of others to the web with out their permission. I.e. if you have purchased a CD, you cannot upload the music to your site just because you have purchased it. You're rights to the CD extend only to listening to it in a private setting, not placing it where others can access it for free.
According to benedict.com, some items that cannont be copyrighted include: ideas, facts, names, titles, blank forms.
However, a copyrighted work may be used according to the fair use doctrine. According to US copyright law, a copyrighted work may be a candidate for fair use if it meets the following criteria:
- "The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes
- The nature of the copyrighted work
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole
